A marriage file succeeds on compliance, not on speed

A marriage between a Chinese and a French national brings together two civil registration systems that do not match. France expects a recent birth certificate; China issues a birth certificate once and for all. France works with a family record book; China works with the hukou, the household register. Every document must therefore be not only translated, but made legible to the authority receiving it.

That is the purpose of a sworn translation: produced by a translator registered on the list of court-appointed experts of a court of appeal — in my case the Riom Court of Appeal — and bearing a seal, a signature and a unique registration number. This status applies throughout France: no town hall may require a translator from its own department.

The Chinese documents town halls most often request

The advice that saves the most money. Ask your town hall for the written list of required documents before commissioning any translation. Requirements vary appreciably between municipalities, and paying to translate a document that will not be requested is the most common wasted expense on this type of file.

The preliminary interview: the step nobody plans for

When one of the future spouses does not speak French well enough, the registrar conducts the preliminary interview provided for by the Civil Code with the assistance of an interpreter. This is not a formality: it is intended to establish that consent is genuine, and the two spouses may be heard separately.

Town halls almost systematically refuse to let a family member or friend interpret, and many require an interpreter registered on a list of court-appointed experts. Apostille or legalisation: what changed in November 2023

Since the Hague Convention entered into force for China in November 2023, Chinese public documents intended for France are in principle covered by the apostille, rather than by double legalisation through the Chinese ministry and then the French consulate. The apostille is obtained from the competent Chinese authorities, before the documents are sent to France.

The order of operations is decisive. The Chinese document is apostilled first, in its original language; the sworn translation follows, in France. Proceeding the other way round regularly means starting over. Tell me the destination town hall and the country of issue of each document, and I will set out the exact sequence before you undertake anything.

Marrying in China rather than in France

The procedure is reversed. The French spouse must obtain a certificate of capacity to marry from the competent French consulate general, after publication of the banns and, in most cases, an interview. French documents then travel to China and must be translated into Chinese.

Once the marriage has been celebrated, the Chinese certificate must be translated and then transcribed into the French civil registers. Without this transcription, the marriage does not exist as far as the French administration is concerned: no family record book, no long-stay visa for the spouse, no effect on nationality. It is the costliest oversight in the whole process.
